Divorce by mutual consent

Consensual divorce is the simplest and fastest form of dissolution of a marriage. In addition, it is a much more economical way than a contested divorce and involves significantly less hassle and paperwork for the spouses. Two lawyers (representation for each spouse) and a notary public are involved in the process. During the process of issuing a consensual divorce, a number of outstanding issues are regulated, such as:

  • Custody of children
  • Communication between spouses and children
  • Alimony
  • Division of movable and immovable property
  • Determination of family housing, etc.
Procedure for issuing a consensual divorce

The procedure for issuing a divorce with the consent of both spouses is simple and requires only two lawyers, a notary, and five documents:

1. The first step is for each of the two spouses to turn to a family law lawyer (two different lawyers that is) and express their will for a mutually consensual dissolution of their marriage.

2. Subsequently, and guided by their lawyers, the two spouses agree to sign before the district civil court, a private agreement that regulates issues such as alimony, property, child custody, etc.

3. The lawyers collect the necessary documents (birth certificate of children, alimony agreement, child custody, etc., spouses’ ID cards, marriage certificate, and marital status certificate) and then file the request for the dissolution of the marriage.

4. Ten days after filing the request, the deed of dissolution of the marriage is signed before a notary public.

Finally, the deed of dissolution of the marriage is submitted to the Registry Office, in which the solemnization of the marriage was declared. After this the dissolution of the marriage is finalized and formalized.
